The man grabbed the can and denied it was his, but he did confess to drinking “two draft beers.” He was asked to step out the car, which he had difficulty doing. The deputy smelled alcohol on the man’s breath, but the man refused to take a breath test. He was arrested after refusing twice and taken to the jail.
