A Hinesville City Council member is out on bond after getting stopped for a charge of driving under the influence over the weekend.
Jose Ortiz, the District 5 council member, was booked into Liberty County Jail on Friday night, charged with DUI and failure to meet the tail light requirement.
Ortiz was released on $1,818 bond.
According to a sheriff’s office report, Ortiz was pulled over on Highway 84 near its intersection with Wallace Martin Drive after a deputy noticed an inoperable taillight on Ortiz’s vehicle. The deputy reported a smell of alcohol and marijuana coming from the vehicle. Ortiz was ordered to perform field sobriety tests, completing some of them. He did not agree to take either a blood test or a breathalyzer.
According to the report, Ortiz said he had two beers at a happy hour and had smoked Delta 8, a compound found in the cannabis plant and also can be found in hemp. Delta 8 is legal in 30 states and is legal in Georgia if derived from hemp.
City council is not expected to take any kind of action against Ortiz at this time, as city attorney Linnie Darden III said they will let the legal process play out.
